Terms and Conditions – Rob Engelman

1. Applicability

  1. These terms and conditions apply to all offers, orders and agreements concluded through the webshop of Rob Engelman.
  2. By placing an order, the customer agrees to these terms and conditions.

2. Products and Descriptions

  1. Unless explicitly stated otherwise, all products offered through this webshop are used products.
  2. Used products may show signs of age, use, restoration, repairs, modifications, replaced parts, wear or cosmetic imperfections.
  3. Product descriptions and photographs form an integral part of the product information and are intended to provide a realistic representation of the condition of the product.
  4. Visible signs of use, ageing, discoloration, scratches, dents, pitting, repairs, replaced parts or other characteristics shown in photographs or described in the listing do not constitute defects.
  5. Minor differences between photographs and the delivered product do not entitle the buyer to compensation or cancellation of the agreement.

3. Prices and Payment

  1. All prices are stated in euros.
  2. Shipping costs are charged separately unless expressly stated otherwise.
  3. Orders are shipped only after full payment has been received.
  4. We reserve the right to change prices, shipping rates and offers at any time.

4. Shipping and Delivery

  1. Orders are normally shipped within 3 to 5 business days after payment has been received.
  2. Delivery times are estimates and cannot be guaranteed.
  3. The risk of loss or damage remains with the seller until the goods have been delivered to the consumer or a third party designated by the consumer.
  4. We are not liable for delays caused by carriers, customs authorities, weather conditions, strikes or other circumstances beyond our reasonable control.

5. Right of Withdrawal and Returns

  1. Consumers residing within the European Union have the statutory right to withdraw from the purchase agreement within 14 days after receipt of the product without giving any reason.
  2. To exercise the right of withdrawal, the consumer must submit a withdrawal request through the withdrawal functionality available in the customer account section of the webshop.
  3. If the withdrawal functionality is temporarily unavailable, the consumer may exercise the right of withdrawal by contacting us via email.
  4. The date and time on which the withdrawal request is submitted through the webshop shall be considered the official date and time of withdrawal.
  5. After submitting the withdrawal request, the consumer must return the product within 14 days.
  6. The direct costs of returning the product are the responsibility of the consumer unless applicable law provides otherwise.
  7. The consumer bears the risk of loss, theft or damage during return transport until the returned product has been physically received by us.
  8. The consumer is responsible for ensuring that returned products are adequately packaged to prevent transport damage.
  9. For valuable instruments we strongly recommend insured and trackable return shipping.
  10. The consumer may inspect and test the product only to the extent necessary to establish its nature, characteristics and functioning, as would reasonably be possible in a physical retail store.
  11. The consumer is liable for any reduction in value resulting from handling beyond what is necessary to assess the product.
  12. A reduction in value may be charged in cases including, but not limited to:
    • additional scratches, dents, cracks, corrosion or other damage;
    • missing accessories, documentation, cases, bags, packaging or components;
    • replacement of original parts with non-original parts;
    • modifications or alterations to the product;
    • excessive use beyond reasonable inspection and testing.
  13. All returned products will be inspected upon receipt.
  14. Where permitted by law, any documented reduction in value may be deducted from the refund amount.
  15. Submission of a withdrawal request does not automatically result in a refund. Returned products must first be received and inspected.
  16. Upon valid withdrawal, we will reimburse all payments received from the consumer, including the original standard shipping costs paid for delivery to the consumer.
  17. We may withhold reimbursement until the returned product has been received or until the consumer has provided proof of return shipment, whichever occurs first.
  18. The provisions of this article apply only to consumers and do not affect any statutory rights relating to non-conforming products.

6. Liability

  1. We are not liable for damage resulting from improper use, neglect, modification, improper maintenance or misuse of the delivered products.
  2. Our total liability shall never exceed the amount paid for the product concerned, except where mandatory law provides otherwise.

7. Privacy and Data Processing

  1. Personal data is processed only for order handling, customer service and legal obligations.
  2. We do not sell personal information to third parties.
  3. Personal data is handled in accordance with applicable privacy legislation.

8. Force Majeure

  1. In the event of force majeure, including but not limited to natural disasters, strikes, pandemics, carrier failures, power outages or government measures, we may suspend or terminate the agreement without liability.

9. Governing Law and Disputes

  1. These terms and conditions are governed by Dutch law.
  2. Mandatory consumer protection provisions applicable in the consumer's country of residence remain unaffected.
  3. Disputes shall be submitted to the competent court in The Netherlands unless mandatory law requires otherwise.
